Terms and Conditions of Sale
These general terms and conditions of sale are concluded between the simplified joint-stock company Karitale, whose registered office is located at 19 rue du Stade, 30230 Bouillargues, France, registered with the Nîmes Trade and Companies Register under number 910 513 431 (hereinafter referred to as “Karitale”), and any individual or legal entity, acting as a non-professional, wishing to purchase product(s) on the website www.karitale.com (hereinafter referred to as the “Buyer”).

Article 1. Purpose
These general terms and conditions of sale aim to define the contractual relationship between Karitale and the Buyer, as well as the conditions applicable to any purchase made through the website www.karitale.com.
Access to this site requires an internet connection, the cost of which is borne by the Buyer.
Purchasing a product through this website implies full and unconditional acceptance of these terms and conditions of sale, which the Buyer acknowledges having read prior to placing an order. Before any transaction, the Buyer declares that (i) the purchase of products on www.karitale.com is not directly related to their professional activity and is limited to strictly personal use, and (ii) that they have the full legal capacity to enter into this contract.
Karitale reserves the right to modify these terms and conditions at any time, to comply with new regulations or to improve site usability. Consequently, the applicable conditions will be those in force at the date of the Buyer’s order. Karitale will inform the Buyer of any changes, and the Buyer must accept the new conditions before completing a purchase.
Article 2. Products
The products offered for sale are those listed on www.karitale.com, subject to availability at the time of order. Karitale reserves the right to modify its product range at any time. Each product is presented with a detailed description including its main technical features (capacity, usage, composition). The photographs are as accurate as possible.
The sale of products listed on www.karitale.com is open to Buyers residing in countries that fully authorize the importation of such products.
Article 3. Prices
The prices listed in the online catalog on Karitale’s website are in euros (€), all taxes included (VAT applicable on the date of the order). Any change in the VAT rate may affect product prices.
Karitale reserves the right to modify its prices at any time; however, the price applicable to the Buyer will be the one in effect at the time of the order.
Prices do not include delivery fees, which are charged in addition and displayed during checkout.
For metropolitan France, delivery is free for orders over €80 (tax included).
Article 4. Orders and Payment Terms
A customer account must be created to place an order. The Buyer must provide accurate, complete, and up-to-date personal information. Karitale cannot be held responsible for delivery failures or delays due to incomplete or incorrect information.
Secure payment by credit card:
The Buyer selects the desired products, adds them to the cart, verifies or updates the delivery address, and confirms the order after reviewing and accepting these terms and conditions.
The Buyer is then redirected to a secure payment interface to enter credit card details. Once payment is accepted, the order is confirmed and the contract is finalized. Payment by credit card is irrevocable.
All data provided and the recorded confirmation serve as proof of the transaction. Karitale will send a confirmation email upon successful order registration.

Article 5. Retention of Ownership
Karitale retains full ownership of the products sold until full payment of the price, including fees and taxes.
Article 6. Delivery
Deliveries are made to the address provided by the Buyer during checkout. Estimated delivery times are provided during order validation and correspond to average processing times. Karitale uses third-party carriers (postal or courier services) and cannot be held liable for delivery delays or failures beyond its control.
Karitale will provide the Buyer with a tracking number by email. Deliveries are made to the Buyer’s home or to a pickup point, depending on the option selected. In case of absence, the carrier will leave a notice of attempted delivery.
The Buyer must check the condition of the packaging and contents upon delivery and notify the carrier and Karitale (contact@karitale.com) of any damage or irregularity within three business days. Claims made after this period cannot be processed.
Delivery costs also include order preparation fees. If the Buyer fails to collect a parcel from a pickup point within the specified time, reshipping costs will be charged to the Buyer.
Delays caused by the carrier do not entitle the Buyer to cancel the sale, refuse delivery, or claim compensation.
Karitale cannot be held responsible for incorrect delivery details provided by the Buyer. Once payment is completed, the delivery address cannot be changed.
Article 7. Right of Withdrawal
7.1. Withdrawal Period
The Buyer has 14 working days from the date of receipt to exercise the right of withdrawal without justification and return the product for an exchange or refund.
If the order includes multiple items delivered separately, the withdrawal period begins upon receipt of the last item.
To exercise this right, the Buyer must notify Karitale by email at contact@karitale.com, optionally using the standard form below. Products must be returned within 14 days of notification to:

Returned products must be unused, unopened, and in perfect condition with all original packaging and accessories. Opened, damaged, or incomplete products will not be refunded or exchanged.
Return shipping costs are the Buyer’s responsibility, and returns are made at their own risk.
Refunds (including delivery fees) will be processed within 14 days of product receipt, using the same payment method as the original transaction.
7.2. Exceptions
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

Goods unsealed after delivery that cannot be returned for hygiene or health protection reasons;

Goods that, after delivery, have been inseparably mixed with other items.

Article 8. Warranty
All products supplied by Karitale are covered by legal warranties. In case of non-conformity or hidden defect, products may be returned for repair, exchange, or refund.

8.1. Legal Warranty of Conformity
Buyers have two years from delivery to act under Articles L.217-4 et seq. of the Consumer Code. They may choose between repair or replacement unless one option incurs disproportionate costs.
8.2. Warranty Against Hidden Defects
Under Articles 1641 et seq. of the Civil Code, Buyers are protected against hidden defects making a product unfit for normal use. Claims must be made within two years of discovering the defect.
Article 9. Liability
Karitale cannot be held responsible for any damage or loss resulting from misuse, alteration, or unauthorized modification of the products by the Buyer.
Article 10. Force Majeure
In the event of force majeure as defined by Article 1218 of the Civil Code, the affected party must inform the other within 15 days. Obligations are suspended for the duration of the event. If it lasts longer than three months, either party may terminate the contract without compensation.
Article 11. Intellectual Property
All elements of www.karitale.com (texts, photos, logos, visuals, etc.) remain the exclusive intellectual property of Karitale. Any reproduction or use without authorization constitutes infringement.
Article 12. Personal Data
Karitale complies with all applicable data protection laws, as described in its Privacy Policy.
Article 13. Disputes
Under Article L.612-1 of the Consumer Code, consumers may seek mediation within one year of a written complaint.
